Who we are, and what these terms cover

Pictaria is made by AEDR Advisors LLC ("Pictaria," "we"). These terms cover this website (pictaria.ai) and the supporter program. The two products have their own terms, described below — this page deliberately does not add rules on top of them. Using the site or contributing as a supporter means you accept these terms; if anything here doesn't work for you, the remedy is simple and honest: don't use the site.

Pictaria Server

The server is free software, and its license is its terms. Pictaria Server is licensed under the GNU AGPL-3.0-only. That license — not this page — governs your use of the software, and it includes its own warranty disclaimer and limitation of liability (sections 15 and 16: the software is provided "as is," and to the extent permitted by law, nobody owes you damages arising from using it). We add no further restrictions, because the license itself forbids that and because we wouldn't want to.

The Pictaria name and logo identify this project. The code is yours to fork under the license, and included brand files are covered by the same copyright license. The license does not grant trademark rights in the Pictaria name or logos, or permission to present a derived product as official or endorsed by Pictaria.

Pictaria Frame

The Frame app has its own terms of use, and is distributed through Google Play under Google Play's terms of service. Purchases are one-time unlocks — no subscription — processed through Google Play. Refunds are available when required under Google Play's policies or applicable law; users may request one through Google Play or contact Pictaria support for help. The app talks to your Immich server, your Pictaria Server, and any AI provider you configure with your keys: we operate no service the app depends on. Android's configured speech-recognition service may process voice audio to produce a transcript; details are in the privacy policy.

Answers generated by AI features (voice questions like "what's interesting about this photo") come from the AI provider you configured, and like all AI output they can be wrong. Enjoy them as color commentary on your memories, not as a system of record.

The supporter program

Supporter contributions are exactly what the name says: a voluntary way to support Pictaria's development. In thanks, you receive a supporter key that lights up a badge and recognition in the products. We want to be precise about what that is and isn't:

• A supporter key is a thank-you, not a purchase of software or services. Pictaria Server is free for everyone, supporter or not, and a key grants no additional rights to the software beyond its open-source license.
• It is not a support contract, service-level agreement, or promise of any particular feature, roadmap item, or continued development.
• Keys are personal — they're for you (or someone you gift one to), not for resale.
• Payments use Stripe Managed Payments, Stripe's merchant-of-record solution. Customers see Link as the merchant of record and the purchase as "Sold through Link." The payment terms presented at checkout also apply to the transaction. We see your email address and what you contributed; we never see your full card number.
• Something wrong with a contribution, or want to talk about a refund? Write to support@pictaria.ai — a human answers — or use Link transaction support. Refunds are handled under the terms shown at checkout, your transaction receipt, and applicable law.

This website

• The content here — guides, docs, blog posts, images — belongs to us or our licensors. Read it, link to it, quote it reasonably; don't republish it wholesale as your own.
• The guides describe running software on your own hardware. Self-hosting involves your equipment, your network, and your data, and you follow the guides at your own risk. Back up your photos before you change anything — the docs say this often because we mean it.
• Use the contact, signup, and bug-report forms honestly, and don't attack, overload, or attempt to break the site.
• We may change or remove website content at any time.

No warranties

The website and the supporter program are provided "as is" and "as available," without warranties of any kind — express or implied — to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, AEDR Advisors LLC's total liability arising out of the website or the supporter program is capped at the greater of $50 or the amount you contributed to us in the twelve months before the claim, and we are not liable for indirect, incidental, special, or consequential damages.

Where the law gives you rights these terms cannot limit, the law wins. Nothing in these terms — including the warranty disclaimer, liability limit, or governing-law clause — reduces mandatory rights or remedies where you live. Where the law does not allow a particular exclusion or limit, it applies only to the extent permitted.

Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, except that this choice does not deprive you of mandatory consumer protections that apply where you live.

Changes to these terms

If we change these terms, we'll update this page and its effective date. Changes apply prospectively. Material changes get a mention on the blog and, when appropriate, direct notice to affected supporters using the contact information we have.
